1. Acceptance of Terms

By engaging 0036 Logistics (“Company,” “we,” “us,” or “our”) for transportation, logistics, or warehousing services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms & Conditions, along with any applicable service contracts, quotes, or bills of lading. These terms govern our business relationship.

2. Services Provided

0036 Logistics. provides freight transportation, logistics management, and warehousing services as described in written service agreements or booking confirmations. All services are subject to availability and these terms.

3. Customer Responsibilities

You agree to:

  • Provide accurate, complete, and timely information regarding shipment contents, dimensions, weight, and special handling instructions.

  • Ensure all freight is properly packaged, labeled, and prepared for transport in accordance with applicable laws.

  • For international shipments, provide all necessary customs documentation and assume responsibility for any duties, taxes, or delays caused by incorrect paperwork.

  • Not tender any hazardous materials, illegal goods, or items prohibited for transport without prior written agreement and proper disclosure.

4. Quotes, Rates, and Payment

  • All quotes are valid for the period stated and are based on information provided by the Customer. Quotes may change if specifications change.

  • Invoices are due within the net terms stated on the invoice (e.g., Net 15, Net 30). Late payments may be subject to interest charges of 1.5% per month (18% per annum) or the maximum allowed by law.

  • You are responsible for all applicable taxes, tolls, and accessorial charges (e.g., detention, loading/unloading) as incurred.

5. Liability and Claims

  • Limitation of Liability: Our liability for loss, damage, or delay is limited as set forth in the governing bill of lading, warehouse receipt, or applicable law (e.g., the Carmack Amendment for interstate transport in Canada). In no event shall our liability exceed the actual loss to the affected goods, subject to a maximum limit as provided by law or contract.

  • Claims Process: Any claim for loss, damage, or delay must be submitted in writing to our office within the time frame specified in the applicable contract or by law (typically within 9-15 months of delivery). Failure to file a timely claim constitutes a waiver of the claim.

  • Exclusions: We are not liable for damages caused by acts of God, acts of public enemy, acts of the shipper, inherent vice of the goods, or authority of law.

6. Insurance

While we carry standard cargo liability insurance as required by law, we strongly recommend you obtain separate insurance for the full value of your goods. We can arrange for additional insurance coverage upon your request and at your expense prior to shipment.

7. Warehousing Services

For warehousing clients, specific terms regarding storage fees, handling, load/unload services, inventory liability, and access will be detailed in a separate Warehousing Services Agreement. Until such an agreement is signed, standard industry terms shall apply for storage-at-will.

8. Indemnification

You agree to indemnify, defend, and hold harmless 0036 Logistics., its agents, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these terms, negligence, or violation of law.

9. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, extreme weather, government actions, or mechanical breakdowns.

10. Termination

Either party may terminate a service agreement upon written notice as per the terms of the specific contract. For ongoing arrangements without a fixed term, either party may terminate with reasonable written notice.

11. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of USA & Canada and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts located in USA & Canada.
The parties agree to attempt to resolve any dispute informally through good-faith negotiation prior to initiating any formal proceeding.

12. Amendments

0036 Logistics. reserves the right to amend these Terms & Conditions at any time. The most current version will be posted on our website. Continued use of our services after changes are posted constitutes acceptance of the new terms.

13. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms & Conditions, together with any signed service contracts, bills of lading, or warehouse receipts, constitute the entire agreement between you and 0036 Logistics. regarding the services.
